Terms of Use – SanalPosPRO

Please read this agreement carefully before installation. By using the SanalPosPRO product, you agree to be bound by the terms and provisions listed below.

Definitions and Parties

Definitions:

  • SanalPosPRO: Software product developed as a payment tool for e-commerce systems, published at https://sanalpospro.com.
  • Payment Service: Collection services provided by banks and/or licensed payment institutions.
  • Technical Support: Verbal/written/practical assistance provided by EticSoft to the merchant.

Parties:

  • EticSoft: EticSoft Information Technologies Inc., located at Akdeniz University Technopark R&D-1, K1 5C, Antalya, Turkey.
  • Merchant (ÜİY): The business using SanalPosPRO. Merchant info is provided during installation and usage.

Subject

This agreement defines the conditions and provisions governing the use of SanalPosPRO by the merchant, ensuring legal validity and enforceability.

Commercial, Intellectual, and Industrial Property Rights

  • SanalPosPRO is open-source software. All intellectual and industrial rights belong to EticSoft.
  • SanalPosPRO is provided FREE OF CHARGE and as OPEN SOURCE under this agreement.
  • The code may not be copied, distributed, renamed, sold, or monetized in any way.
  • The LICENSE file in the main directory is binding and may not be removed or altered.
  • Merchants may modify their own copies but accept all responsibility for the outcomes.
  • EticSoft is not responsible for compatibility with a merchant’s server environment.
  • EticSoft may restrict or revoke access if legal or ethical violations occur.

Technical Support

  • Free technical support may be requested via EticSoft’s website.
  • EticSoft is not obligated to resolve all issues; non-response does not imply liability.
  • No guarantees are made regarding response or resolution time.
  • Merchants may share temporary access credentials for support purposes.
  • Merchants are responsible for changing passwords after support ends.
  • All data must be backed up before requesting support. EticSoft is not liable for data loss.
  • Custom services like design or private integrations may incur costs, only with prior consent.
  • Refusal to share access may limit support options.

Disclaimer

  • SanalPosPRO is provided “as-is” with no guarantees of uninterrupted operation.
  • EticSoft accepts no liability for any damages from using the software.
  • The merchant is responsible for all legal compliance and consequences of software usage.
  • Payment provider terms must also be observed by the merchant.

Usage Restrictions

  • The software may only be used by the licensed business.
  • The merchant may not resell, sublicense, or rent the software to others.
  • Usage is limited to the business details submitted during installation.

Termination

  • EticSoft may suspend or revoke licenses without explanation in case of violations.
  • Upon termination, all copies of the software must be removed from systems.

Jurisdiction

In case of legal disputes, the courts and enforcement offices of Antalya, Turkey have jurisdiction.
